Site Terms of Use

These Site Terms of Use set out the rules governing the use of the Nura Aydınlatma website published at nuraaydinlatma.com. Anyone who visits the site, browses its pages, fills in the contact or newsletter form or places an order is deemed to have read and accepted these terms.

Pursuant to Law No. 6563 on the Regulation of Electronic Commerce (Elektronik Ticaretin Düzenlenmesi Hakkında Kanun) and the Regulation on Service Providers and Intermediary Service Providers in Electronic Commerce (Elektronik Ticarette Hizmet Sağlayıcı ve Aracı Hizmet Sağlayıcılar Hakkında Yönetmelik), the information concerning the service provider is set out below:

Nura Aydınlatma sells the products offered on the site in its own name and on its own account. The site is not a marketplace; since no listings or stores belonging to third parties are hosted, it does not have the status of an intermediary service provider. Our physical showroom in Sultangazi and our central warehouse belong to the same business.

This text concerns the general use of the site. If you purchase a product, the Preliminary Information Form and the Distance Sales Contract additionally enter into force; in matters relating to the sale such as delivery, payment, the right of withdrawal and defective goods, those documents apply in the first place. In the event of a conflict between the documents, the provision that is in favour of the consumer prevails pursuant to Law No. 6502 on the Protection of Consumers (Tüketicinin Korunması Hakkında Kanun) and the Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği).

The site is provided for the purpose of presenting and selling our products. The User agrees to use the site in a manner that complies with the law, with morality and with these terms. The following obligations must be observed:

• The name, address, telephone number and e-mail address given in the order and contact forms must be correct, up to date and complete. Nura Aydınlatma cannot be held responsible for a delay in delivery or for an invoice being issued incorrectly because of wrong or incomplete information.
• No conduct may be engaged in that would obstruct or slow down the operation of the site or endanger its security; sending requests that place a disproportionate load on the server, attempting to circumvent security measures and unauthorised access attempts are prohibited.
• The content on the site may not be collected, copied or transferred to another medium by means of automated software, robots, spiders or scraping tools. The bulk extraction of price, stock and product data also falls within the scope of this prohibition.
• No reverse engineering may be carried out on the software and infrastructure of the site; the source code may not be decompiled or modified and no derivative work may be produced.
• No virus, trojan horse, worm or any other malicious software capable of harming the integrity of the system may be uploaded, sent or spread to the site.
• No transaction may be carried out using another person's name, address, telephone number, e-mail address or means of payment; carrying out a transaction on behalf of someone else is conditional upon being authorised to do so.
• No messages containing insults, threats or defamation, infringing the rights of third parties or otherwise unlawful may be sent through the forms; the forms may not be used for advertising or bulk messaging.
• The trade mark and logo of Nura Aydınlatma may not be used to create the impression of a connection with the company, and no unauthorised statement may be made on behalf of the site.

Users under the age of eighteen may carry out transactions through the site only with the knowledge and consent of their parent or guardian. As the installation of lighting products requires an electrical connection, the order must be placed by an adult.

In the event of a breach of these obligations, Nura Aydınlatma reserves the right to restrict access to the site temporarily or permanently, to cancel the order and to pursue legal remedies in respect of any damage incurred.

The rights in the design, interface, software, database, texts, product descriptions, photographs and videos of the site, in the "Nura Aydınlatma" trade mark and logo and in all other content on the site belong to Nura Aydınlatma or to the rightholders who have assigned the right of use to Nura Aydınlatma. This content is protected under Law No. 5846 on Intellectual and Artistic Works (Fikir ve Sanat Eserleri Kanunu), the provisions on unfair competition of the Turkish Commercial Code No. 6102 (Türk Ticaret Kanunu) and the relevant industrial property legislation.

Viewing the site does not give you any ownership or licence right in the content. Without our written permission, the following acts may not be carried out in respect of all or part of the content:

• Copying, reproducing or distributing it and republishing it in another medium.
• Adapting or modifying it or producing derivative content from it.
• Using it for commercial purposes, selling it or including it in the catalogues, listings and advertisements of another business.
• Publishing the product photographs on other websites, on marketplaces or on social media accounts.
• Using the trade mark and logo in a manner that would cause confusion.

Viewing a page or printing it out for personal use does not fall within the scope of this prohibition. Linking to one of our pages without altering the content and while citing the source is permitted; where the site is framed within another page or the content is presented as if it were that party's own content, the provisions on unfair competition are reserved.

In the event of unauthorised use, the civil and criminal remedies arising from the relevant legislation will be pursued. If you believe that content on the site infringes your rights, you may notify us through the contact channels set out in the company information; your application will be examined and, if considered necessary, the content will be removed from publication.

Product descriptions, dimensions and material information are prepared in order to present the product as accurately as possible. Measurements such as the width, height and drop length of each product, together with the socket type and material information, appear on the relevant product page; before making your choice we recommend that you check whether this information is compatible with the ceiling height and the electrical infrastructure of your space.

The product photographs are of the actual product; however, depending on screen settings and ambient light, colour perception may vary from device to device, and differences in tone may be seen on crystal and glass surfaces because of reflection. Differences of this kind are not a defect arising from manufacture. If you are unsure, you may visit our showroom or consult us by telephone or on WhatsApp.

Prices are shown in Turkish Lira and include VAT. Shipping is free and insured to anywhere in Türkiye; no additional shipping charge is applied whatever the order amount. The instalment options defined for your card are displayed at the payment step. Requests for delivery abroad are assessed by means of a special quotation prepared according to the country concerned.

Prices and campaign conditions may be changed without prior notice. However, such changes do not affect orders already placed; the price that applies to you is the price you confirmed at the time of the order and that appears in the Preliminary Information Form.

Although stock information is kept up to date, a product may have sold out after an order has been placed because of showroom sales and simultaneous orders. If it becomes apparent that the product cannot be supplied, you will be informed within the period laid down in the legislation; if you wish, the order will be cancelled and the full amount you have paid will be refunded, or, if you prefer, it will be exchanged for another equivalent model.

The technical care required for the secure operation of the site is exercised; nevertheless, it is not guaranteed that the site will at all times be uninterrupted, error free and accessible. Access may be temporarily suspended because of planned maintenance work, software updates, server and infrastructure failures, power or internet outages, cyber attacks and force majeure events such as natural disaster, fire and strike.

Nura Aydınlatma cannot be held responsible for interruptions of this kind occurring without its own fault, or for problems arising from the User's internet connection, device or browser. The lighting recommendations on the site are of a general informative nature and, as the installation of every space is different, they do not take the place of a design project or an engineering service.

Products are shipped together with mounting hardware and installation instructions. For the safety of life and property, we recommend that the electrical connection be made by an authorised electrician; this is not an obligation. Nura Aydınlatma does not sell a separate installation service and does not undertake the installation work; we provide support by telephone at any point where you get stuck during assembly. Damage arising from incorrect installation is outside the scope of the warranty.

The site contains links and embedded content belonging to third parties. Our contact and store pages include a Google Maps map showing the location of our showroom, and our home page includes a promotional video published over the Cloudflare Stream infrastructure. Links directing you to our social media accounts and to our WhatsApp contact line are also provided.

Nura Aydınlatma has no control over the security, privacy practices and cookie use of these links and content. When you leave the site by clicking on a link, the terms of use and the privacy policy of the platform you go to apply. Detailed information about the fact that the relevant providers may place their own cookies while embedded content is loading is given in our Cookie Policy.

No responsibility is accepted for posts on third party platforms that appear to have been made on behalf of Nura Aydınlatma but do not belong to our official accounts. Our official sales channel is the address nuraaydinlatma.com together with the contact details set out in the company information.

The personal data you share through the site is processed in accordance with Law No. 6698 on the Protection of Personal Data (Kişisel Verilerin Korunması Kanunu) and the relevant secondary legislation; the data controller is Nura Aydınlatma. Which data is processed for which purpose and on which legal ground, to whom it is transferred, the retention periods and your rights listed in Article 11 of the Law are explained in the KVKK Disclosure Text.

The contact form collects your name, e-mail address, optionally your telephone number, the subject and the message; the newsletter form collects only your e-mail address. A rate limit based on IP address is applied in order to prevent misuse of the forms. The site has no membership or account system and your card details are not stored on the site; payment transactions are carried out over the 3D Secure infrastructure of banks and payment institutions.

To obtain information about cookies and similar technologies and to manage your preferences you may consult the Cookie Policy, and for our general privacy practices the Privacy and Security Policy. Commercial electronic messages are sent pursuant to Law No. 6563 (Elektronik Ticaretin Düzenlenmesi Hakkında Kanun) and the Regulation on Commercial Communication and Commercial Electronic Messages (Ticari İletişim ve Ticari Elektronik İletiler Hakkında Yönetmelik) and in accordance with the consents managed through the Message Management System (İleti Yönetim Sistemi).

You may submit your requests concerning your personal data through the KVKK Data Subject Application Form, in accordance with the procedure laid down in the Communiqué on the Procedures and Principles of Application to the Data Controller (Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ). The retention and destruction of data is carried out in accordance with the provisions of the Regulation on the Deletion, Destruction or Anonymisation of Personal Data (Kişisel Verilerin Silinmesi, Yok Edilmesi veya Anonim Hale Getirilmesi Hakkında Yönetmelik).

Nura Aydınlatma reserves the right to amend these Site Terms of Use unilaterally because of changes in the legislation, developments in the scope of the services offered or updates to the technical infrastructure. The updated text enters into force as soon as it is published on this page.

You can see which version you are reading from the last updated information at the top of the page; we recommend that you review this page from time to time before using the site.

Changes do not have retroactive effect. For orders that have already been confirmed, the terms in force on the date the order was placed and the provisions of the Preliminary Information Form and the Distance Sales Contract you confirmed for that order apply.

Turkish law applies to the interpretation and application of these terms. We attach importance to resolving any disputes that may arise from the use of the site amicably, in the first instance through our contact channels.

In disputes arising from consumer transactions, pursuant to Law No. 6502 on the Protection of Consumers (Tüketicinin Korunması Hakkında Kanun) and within the framework of the monetary limits redetermined each year by the Ministry of Trade (Ticaret Bakanlığı), the District or Provincial Consumer Arbitration Committees (İlçe veya İl Tüketici Hakem Heyetleri) at the consumer's place of residence or at the place where the transaction was carried out have jurisdiction, and for disputes above those limits the Consumer Courts (Tüketici Mahkemeleri) have jurisdiction. In places where there is no Consumer Court, such cases are heard by the Civil Courts of First Instance (Asliye Hukuk Mahkemeleri) sitting as consumer courts. You may also submit your applications electronically through the Consumer Information System (Tüketici Bilgi Sistemi) of the Ministry of Trade.

In disputes that may arise between us and persons who do not have consumer status, and in other disputes relating to the use of the site, the courts and enforcement offices of İstanbul have jurisdiction. This provision does not limit the right of consumers to apply to the arbitration committees and the courts at their own place of residence.

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions retain their validity.
