Commercial Electronic Message Disclosure and Consent Text

Explains through which channels Nura Aydınlatma sends campaign and new collection announcements, how consent is recorded in İYS and your right to refuse.

1. Purpose and Scope

This text has been prepared pursuant to Law No. 6563 on the Regulation of Electronic Commerce (Elektronik Ticaretin Düzenlenmesi Hakkında Kanun) and the Regulation on Commercial Communication and Commercial Electronic Messages (Ticari İletişim ve Ticari Elektronik İletiler Hakkında Yönetmelik). Its purpose is to inform you clearly about the content of the commercial electronic messages that will be sent to you by Nura Aydınlatma in its capacity as service provider, the channels through which they will be sent, how the consent you give is recorded and how you may withdraw that consent at any time.

Under the legislation, a "commercial electronic message" means a message with data, sound or image content that is carried out in an electronic environment and sent for commercial purposes by means such as the telephone, a call centre, fax, automatic dialling machines, smart voice recording systems, electronic mail or the short message service. The "recipient" is the natural or legal person to whom such a message is sent.

This text covers recipients who fill in the newsletter sign-up form on nuraaydinlatma.com, or who separately declare during the order process, or through channels such as e-mail, telephone and WhatsApp, that they wish to receive commercial electronic messages. Giving consent is not a precondition for shopping on the site or for contacting us; you may place an order, visit our showroom and benefit from all of our customer services without giving consent. The service provider details are set out below.

2. Message Types and Channels Covered by Consent

If you give your consent, commercial electronic messages may be sent to you through the channels below. Unless you state otherwise, your consent covers all of these channels; if you wish, you may choose to receive messages through one particular channel only and refuse the others.

Instant messaging is not managed through İYS; your consent and refusal records for this channel are kept directly by Nura Aydınlatma, and it is enough to write your refusal request to us on the same line.

The content of the messages sent through these channels is limited to lighting products, which is our field of activity. The main message types covered by consent are as follows:

  • Presentation of new products and collections such as living room chandeliers, pendant lamps, crystal chandeliers, glass chandeliers, wall sconces, floor lamps, table lamps, ceiling lamps and LED lighting.
  • Campaign, discount, end-of-season offer and special day announcements, together with their period of validity and conditions.
  • Announcements of presentations and invitations held at our showroom in Sultangazi, and special notices regarding showroom opening hours.
  • Recommendations relating to the product groups you like, announcements of models back in stock and newsletter content.
  • Invitations to surveys, satisfaction assessments and feedback on your product experience.

In the course of sending commercial electronic messages, your contact details are not sold or rented to third parties and are not used to promote third parties falling outside the scope of your consent. The frequency of sending is kept at a reasonable level; outside intensive campaign periods, messages are not sent at short intervals.

3. Scope of Consent and İYS Registration

As a rule, the sending of commercial electronic messages depends on your prior consent being obtained. Consent is given in writing or through any electronic communication tool, by your affirmative declaration of intent. On our site, consent boxes are not presented pre-ticked, consent is not made a condition of another transaction, and the consent text is not concealed within transactions such as completing an order.

Your consent contains your declaration that you permit commercial electronic messages to be sent, together with your contact details such as your electronic mail address and telephone number. Because the obligation to prove the existence of consent lies with the service provider, the record of the date and time on which consent was obtained is kept by Nura Aydınlatma for the period prescribed in the legislation.

Message Management System (İleti Yönetim Sistemi, İYS)

The consents you give and the refusal notifications you make are recorded in the Message Management System (İleti Yönetim Sistemi, İYS), operated under the supervision of the Ministry of Trade (Ticaret Bakanlığı) pursuant to the Regulation on Commercial Communication and Commercial Electronic Messages (Ticari İletişim ve Ticari Elektronik İletiler Hakkında Yönetmelik). No commercial electronic message is sent to you on the basis of a consent that is not registered in İYS. Registration in İYS operates for the electronic mail, short message and call channels. Because instant messaging applications such as WhatsApp are not managed through İYS, your consent and refusal records for that channel are kept directly by Nura Aydınlatma, and sending is stopped once you tell us that you no longer wish to receive messages through it.

  • Through İYS you can view, in a single place, which companies you have given consent to and for which channels.
  • You can give, change or withdraw your consents separately on a channel basis (e-mail, short message, calls).
  • You can submit your refusal notification directly through İYS and follow in the system whether that notification has reached the sender.
  • Use of İYS is free of charge for recipients; you can access the system through e-Devlet or through İYS's own channels.

Changes you make in İYS take effect from the moment they are processed in the system and are reflected in our sending lists. It is not compulsory to apply to us separately in order to change your consent or refusal status; however, if you wish, you may also submit your request through the contact channels below.

4. Cases Where Consent Is Not Required

Notices aimed at maintaining an existing order, contract or customer relationship do not qualify as commercial electronic messages, and your consent is not sought separately for them. Such notices are compulsory so that your order can be carried out and our legal obligations can be fulfilled:

  • Order received and order confirmation notifications, and confirmation of payment or of collection by bank transfer/EFT.
  • Notifications concerning shipment preparation, the consignment tracking number and the delivery process.
  • Information relating to withdrawal, return, exchange and refund processes.
  • Delivery of the e-Archive invoice to your e-mail address, the warranty certificate and product usage information.
  • Information on the installation, use and maintenance of the product and on the supply of spare parts.
  • Replies given to the questions and requests you send us through the contact form, by telephone or via WhatsApp.
  • Announcements of changes to contractual terms and to the privacy and cookie policies, together with other notifications required by legislation.

Notices of this kind continue to be sent even if you have refused to receive commercial electronic messages, because they carry no promotional or marketing purpose. Messages sent to you because you have obtained a product or service, concerning changes to, the use of and the maintenance of the product you obtained, are likewise not subject to separate consent under the legislation.

Where the recipient is a merchant or a tradesman, commercial electronic messages may be sent without prior consent pursuant to the Regulation. The right to refuse is reserved in that case as well; when a merchant or tradesman recipient notifies that they refuse to receive messages, sending is stopped.

5. Right to Refuse

You may refuse to receive commercial electronic messages at any time, without giving any reason, without paying any fee and by an easy means. You do not need to obtain our permission or to give an explanation in order to exercise your right to refuse; no additional charge is requested from you for your refusal notification.

You may submit your refusal notification by any of the following means. Whichever means you choose, your notification has the same validity:

  • By clicking the unsubscribe (refusal) link found at the end of the electronic mail messages sent to you.
  • By using the refusal method stated in messages sent by short message.
  • By withdrawing, through the Message Management System (İleti Yönetim Sistemi, İYS), the consent you gave for the relevant channel.
  • By writing your refusal request to the electronic mail address given in the company details.
  • By calling us on the telephone line given in the company details, or by sending a WhatsApp message to the same line; a refusal request concerning the instant messaging channel reaches us directly rather than through İYS and is processed in our own records.

Your refusal request is fulfilled within three business days at the latest from the date it reaches us, and the sending of commercial electronic messages through the relevant channel is stopped. Your refusal notification concerning the electronic mail, short message and call channels is also processed in İYS within the same period; for instant messaging channels such as WhatsApp, your request is processed in our own records rather than in İYS and sending is stopped within the same period. Because system sending lists need to be updated, a message already prepared for sending just before your refusal request may reach you shortly afterwards; this does not mean that your refusal request is invalid.

In your refusal notification you may state which channel you are refusing. For example, you may refuse only the short message and call channels and choose to remain subscribed to the electronic mail newsletter. If you do not specify a channel, your request is treated as a request to stop the sending of commercial electronic messages through all channels. After exercising your right to refuse, you may subscribe to the newsletter again at any time by giving your consent anew.

6. Processing of Personal Data

Within the scope of sending commercial electronic messages, your name, your electronic mail address and your telephone number, together with your consent and refusal records (the channel through which consent was obtained and the date and time information), are processed. This data is processed on the basis of your explicit consent pursuant to the first paragraph of Article 5 of Law No. 6698 on the Protection of Personal Data (Kişisel Verilerin Korunması Kanunu). The retention of consent and refusal records and their transfer to İYS, on the other hand, rest on the legal ground of fulfilling our legal obligation.

Your data may be transferred to the electronic mail and messaging infrastructures used so that messages can be sent, and to the Message Management System (İleti Yönetim Sistemi) for the purpose of keeping consent and refusal records. Transfers are made only to the extent required by the sending and by compliance with the legislation.

You may withdraw your explicit consent at any time. Withdrawal of consent produces effect for the future; it does not affect sendings lawfully carried out up to the date of withdrawal. When you withdraw your consent, your contact data other than the consent and refusal records that must be kept under the legislation is removed from our sending lists and destroyed in accordance with the provisions of the Regulation on the Deletion, Destruction or Anonymisation of Personal Data (Kişisel Verilerin Silinmesi, Yok Edilmesi veya Anonim Hale Getirilmesi Hakkında Yönetmelik).

For detailed information about the purposes for which your personal data is processed, the parties to whom it is transferred, the retention periods and your rights listed in Article 11 of the Law, you may review the KVKK Disclosure Text. In your capacity as a data subject, you may submit your requests through the KVKK Data Subject Application Form (KVKK Veri Sahibi Başvuru Formu), in a manner complying with the procedure set out in the Communiqué on the Procedures and Principles of Application to the Data Controller (Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ), or through the contact channels given in the company details.

7. Content of the Messages

In every commercial electronic message sent to you, the commercial nature of the message is apparent at first sight and beyond any doubt, and the party on whose behalf the message is sent is clearly stated. The subject of the message is consistent with its content and no misleading expressions are used.

  • Identity of the sender: the name of Nura Aydınlatma and its brand information are clearly stated in the message.
  • Contact details: the telephone number, electronic mail address and website address are included in the message.
  • An expression showing that the message is of a commercial nature, indicating its promotional or campaign character.
  • An easily accessible refusal notification method that can be used free of charge.
  • In campaigns involving discounts and gifts, the period of validity of the campaign and the conditions for benefiting from it.

The content of the messages is prepared in accordance with the consent you have given. Where a message needs to be sent on a different subject falling outside the scope of your consent, your consent is obtained separately. In promotions containing price information, prices are stated in Turkish Lira and inclusive of VAT; campaign conditions are not presented in a way that contradicts the information given on the product pages of the site.

The images, texts and designs contained in the messages are protected under Law No. 5846 on Intellectual and Artistic Works (Fikir ve Sanat Eserleri Kanunu) and the unfair competition provisions of Turkish Commercial Code No. 6102 (Türk Ticaret Kanunu); they may not be reproduced without permission or used for commercial purposes.
